Terms of Service

1. Platform Overview

The Endolum Platform provides cybersecurity products and services, including but not limited to:

• Sentinel (sentinel.endolum.io): Infrastructure vulnerability scanning with AI powered remediation reports.
• Hacked (hacked.endolum.io): Canary document tracking for breach detection.

Each product may have additional product specific terms accessible through its respective application. In case of conflict, product specific terms take precedence over these general terms.

2. Account Responsibilities

• You must provide a valid business email address and accurate company information to create an account.
• You are responsible for keeping your account credentials secure.
• You must notify us immediately if you suspect unauthorized access to your account.
• You are responsible for all activity that occurs under your account and within your organization.
• You may not share your account credentials or create duplicate accounts.

3. Acceptable Use

You agree to use the Platform only for lawful purposes:

• You may only use security scanning and monitoring tools on systems, networks, and environments you own or have explicit written authorization to test.
• You may not use any Endolum service for unauthorized surveillance, stalking, harassment, or any activity that violates applicable law.
• You may not attempt to disrupt the Platform, circumvent its security measures, or interfere with other users.
• You may not reverse engineer, decompile, or extract source code from the Platform.
• You may not resell or redistribute access to the Platform without written permission.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on severity.

4. Subscriptions and Payment

• Some products offer a free tier with limited functionality. Paid subscriptions unlock additional features and capacity.
• Payments are processed through Stripe. By subscribing, you also agree to Stripe's Terms of Service.
• All prices are in Swiss Francs (CHF) and exclude applicable taxes.
• Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless cancelled.
• You may cancel your subscription at any time. Access continues until the end of the current paid period.
• Refunds are not provided for partial billing periods unless required by law.

5. Service Availability

We strive to maintain high availability across all services, but do not guarantee uninterrupted access. Free tiers come with no service level agreement (SLA). Planned maintenance will be communicated in advance where possible. We are not liable for downtime, data loss, or missed alerts caused by service interruptions, network issues, or force majeure events.

6. Limitation of Liability

The Platform is provided "as is" without warranties of any kind, whether express or implied. To the maximum extent permitted by Swiss law:

• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
• We do not guarantee the accuracy, completeness, or reliability of scan results, vulnerability reports, alert data, or any other output generated by the Platform.
• Security tools are aids, not guarantees. The absence of findings does not mean the absence of vulnerabilities or breaches.
• Our total liability for any claim related to the Platform is limited to the amount you have paid us in the 12 months preceding the claim, or CHF 100, whichever is greater.

7. Termination and Account Deletion

• You may deactivate or permanently delete your account at any time through the portal settings.
• Account deletion cascades across all Endolum services. Your personal data, scan results, documents, alert history, and other service data will be permanently removed.
• Active subscriptions should be cancelled before account deletion. We are not responsible for charges incurred on subscriptions that were not cancelled prior to deletion.
• We may terminate or suspend your account for violations of these terms.

8. Intellectual Property

The Platform, including its design, code, reports, and documentation, is owned by Endolum GmbH. You retain ownership of any data or documents you upload to the Platform. By uploading content, you grant us a limited license to process it as part of the service functionality.

9. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. If we make significant changes that affect your rights, we will notify registered users by email at least 30 days before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance.

10. Governing Law and Jurisdiction

These terms are governed by Swiss law. Any disputes arising from or related to these terms or the Platform will be subject to the exclusive jurisdiction of the courts at the registered office of Endolum GmbH (Lachen SZ, Switzerland).
